Jam Portal Terms of Service
1. Agreement to these Terms
These Terms govern access to and use of Jam Portal.
By creating or using a Venue Admin or Staff account, accepting an invitation, paying for a Jam Portal subscription, or otherwise using Jam Portal after these Terms are presented to you, you agree to these Terms.
If you act for a venue, you confirm that you are authorised to bind or act for that venue.
If you do not agree, do not use Jam Portal.
2. What Jam Portal provides
Jam Portal is a venue music-request and engagement platform. Features may include venue portals and QR access, guest song requests, voting, chat and dedications, feedback, Staff queue moderation, automated queue progression and supported media playback, venue administration and branding, TV/display views, session controls, subscription and manual payment administration, support and operational notices.
Features may change as Jam Portal is improved.
3. Accounts and access
Venue Admin, Staff and Platform Admin access is controlled by authentication and authority checks.
Choosing a dashboard or destination does not grant authority.
You must use only an account you are authorised to use, keep account access secure, promptly report compromise, and ensure Staff access is granted only to authorised people.
Different privileged accounts may require separate browser profiles if they need to remain signed in at the same time.
4. Venue responsibilities
The venue is responsible for its own operation of Jam Portal, including supervising Staff access, managing settings and branding, ensuring lawful Guest use, maintaining suitable internet/devices/audio equipment, complying with public-performance/copyright/music licensing requirements, obtaining any permissions required for minors, and complying with privacy obligations that apply independently to the venue.
Jam Portal does not provide a public-performance, copyright, broadcast or music licence.
5. Media and third-party platforms
Jam Portal may use third-party media, authentication, hosting, email, maps, security, payment and infrastructure services.
Media availability may vary by region, account, device, network, embedding restrictions or third-party platform rules.
Jam Portal does not guarantee that every requested song or video will be available or playable.
You and the venue must comply with applicable third-party terms and applicable copyright, licensing and public-performance requirements.
6. Acceptable use
You must not use Jam Portal to break the law, harass or threaten others, submit unlawful or seriously harmful content, gain unauthorised access, bypass authentication or security controls, interfere with queues/sessions/billing/moderation/infrastructure, flood the service with automated activity, distribute malware, or misuse personal information.
Jam Portal may limit, suspend or remove access where reasonably necessary to protect users, venues, the platform or legal rights.
7. Guest content
Guests and venue users may submit names, song requests, chat messages, dedications, feedback and other content.
The person submitting content remains responsible for it.
You grant Jam Portal a limited permission to process, display, transmit and store that content only as reasonably necessary to provide, moderate, secure and improve the service and to meet legal obligations.
8. Subscriptions
Jam Portal may offer time-based subscription plans.
The plan, duration and price shown or agreed at purchase apply to that purchase.
Current product behaviour may include an active period, a grace period after expiry, restriction after the grace period and account lock after the configured lock period.
Jam Portal may change prices for future purchases or renewals. A change does not retroactively alter a period already paid for.
9. Payments
During the controlled pilot, subscription activation may require manual payment verification and manual approval.
Payment may be arranged directly or through an external payment-service provider made available for the transaction.
Jam Portal does not currently promise automatic recurring billing.
Never send Jam Portal a payment PIN, CVV, full card number, bank password or other secret payment credential.
A subscription is considered activated when Jam Portal confirms activation in the system.
10. Renewal, cancellation and refunds
Pilot subscriptions do not automatically renew unless Jam Portal expressly introduces and you separately agree to automatic renewal.
Cancellation stops future purchases or renewals but does not automatically create a refund for a period already activated.
Refund eligibility is governed by the separate Refund and Cancellation Policy and applicable law.
11. Availability and maintenance
Jam Portal aims to provide a reliable service, but continuous or error-free availability cannot be guaranteed.
Temporary interruption may occur because of network or power failure, device problems, maintenance, third-party platform outages or restrictions, security incidents, emergency changes or events beyond Jam Portal's reasonable control.
12. Suspension and termination
Jam Portal may restrict or suspend access because of non-payment, expiry, serious or repeated misuse, security risk, fraud, legal requirements or material breach.
A subscription status such as suspended, restricted or locked does not necessarily mean that an active music session has been atomically stopped. Operational session controls remain separate from subscription status.
The venue may stop using Jam Portal at any time. Data retention after termination is described in the Privacy Policy and Data Retention and User Rights Policy.
13. Privacy
Jam Portal's handling of personal data is described in the Privacy Policy and Data Retention and User Rights Policy.
Venue administrators may have their own obligations to guests and Staff under applicable privacy law.
14. Intellectual property
Jam Portal's software, design, branding, documentation and original platform materials belong to Jam Portal or its licensors.
These Terms do not transfer ownership of Jam Portal intellectual property to you.
Third-party media remains subject to the rights and terms of its owners and providers.
15. Feedback
If you voluntarily send product suggestions or feedback, Jam Portal may use that feedback to improve the service without owing compensation, while still handling any personal data in accordance with the Privacy Policy.
16. Disclaimers
To the maximum extent permitted by applicable law, Jam Portal is provided on an "as available" basis.
Jam Portal does not guarantee uninterrupted availability, availability of every media item, continued availability of any third-party feature, correct operation of venue internet/hardware, or that location/anti-abuse controls are impossible to bypass.
Nothing in these Terms excludes a right or remedy that cannot lawfully be excluded.
17. Limitation of liability
To the maximum extent permitted by applicable law, Jam Portal will not be liable for indirect or consequential loss arising from use of the service, including lost profits, lost business, venue interruption or loss caused by third-party platforms, networks or equipment.
Where liability cannot lawfully be excluded, Jam Portal's responsibility will be limited only to the extent permitted by applicable law.
18. Changes
Jam Portal may update features and these Terms as the product develops.
Material changes will be reflected by an updated effective date and, where appropriate, notice through the service or account communications.
19. Governing law
These Terms are governed by the laws of Uganda.
The parties should first try in good faith to resolve a dispute directly. Nothing in these Terms removes any right to approach a competent regulator, tribunal or court.
